Something Borrowed - Terms and Conditions

1. The service

Something Borrowed is a free ring loan service provided by Neve Jewels AU Pty Ltd (ABN 56 643 947 620) named herein as “Diamonds Factory”, “we”, “us”. We lend you a showroom display ring (a “Loan Ring”) free of charge so you can propose before committing to a real engagement ring together. These terms govern every booking and loan. By registering, you agree to them.

All rings provided under this loan agreement are non-precious display samples constructed from base metals, surface plating, and synthetic Cubic Zirconia (CZ) stones. The customer acknowledges and agrees that the loaned items are strictly temporary visual and fitting samples. They do not contain precious metals (e.g., solid gold, platinum, or silver) or natural gemstones, and hold no intrinsic precious metal or gemstone commodity value.

2. Who can borrow

• You must be 18 or over and provide valid Australian photo identification (driver licence or passport) at collection, matching the name on the booking for verification purpose.
• You must hold a valid credit or debit card in your own name, which will be securely saved for the duration of your loan (see section 5).
• One Loan Ring per person at any time, and a maximum of one loan per person in any 12-month period.
• We may decline or cancel any booking at our reasonable discretion, including where identification or card verification cannot be completed.

3. Booking and availability

• Bookings are made online at diamondsfactory.au/something-borrowed, selecting a participating showroom and a collection date.
• The service is available at Diamonds Factory showrooms across Australia only.
• All rings are subject to availability. Ring styles shown online are indicative - if your selected style is unavailable at collection, we will offer the closest available alternative, and you may decline and cancel at no charge.
• Bookings may be cancelled or rescheduled free of charge any time before collection via diamondsfactory.au/something-borrowed. If you do not collect within 24 hours of your booked collection time, the booking lapses.

4. Collection

• At collection we will verify your ID, record the Loan Ring’s condition with you, and make a pre-authorisation charge of $150 on your card as described in section 5.
• The Loan Ring remains the property of Diamonds Factory at all times during the loan.
• You will receive the Loan Ring in a presentation box with a condition receipt. Keep both - you will need them at return.

5. Your saved card

The loan is free and nothing is charged or held while you have the ring. At collection we you authorise us to make a pre-authorisation charge of $150 AUD. This is a pre-authorisation only and will not be taken from your account as long as you meet the terms outlined in sections 6 and 7.

6. The loan period and returns

• The loan period is 7 days, starting on the day of collection (collection day is day 1).
• Return the Loan Ring to the same showroom by close of business on day 7, with the presentation box and condition receipt. Early returns are welcome.
• If you cannot return in time, contact us before day 7 at the showroom you collected from - we may grant one extension of up to 7 days at our discretion.
• If the Loan Ring is not returned by the end of day 7 (or any agreed extension), we will process the pre-authorised $150 AUD held on your card, representing the agreed purchase price of the Loan Ring. In this event ownership of the Loan Ring passes to you on payment. We will notify you before processing the charge.

7. Care, damage and loss

• Please treat the Loan Ring with reasonable care. Normal careful wear during the loan period is expected and fine - that is what it is for.
• Do not resize, alter, engrave or repair the Loan Ring, or allow anyone else to.
• If the Loan Ring is lost or stolen, contact us immediately by email Service@diamondsfactory.com.au. Where a Loan Ring is lost, stolen or returned with damage beyond fair wear, we may charge the reasonable cost of repair or replacement, up to a maximum of $150, charged to your saved card. We will always assess the ring with you at return, explain any proposed charge, and provide an itemised basis for it before processing.

Transfer of Risk, Liability, and Definition of Damage

• Transfer of Risk: Full risk of loss, theft, destruction, or damage to the loaned sample ring(s) passes to the customer immediately upon physical handover at collection (or delivery). Risk remains entirely with the customer throughout the loan period and only transfers back to the company once the sample ring(s) have been physically received and inspected/verified by an authorized staff member upon return. Unattended returns or unverified drop-offs do not discharge the customer’s liability.
• Definition of Damage: For the purposes of this Agreement, “Damage” means any alteration or impairment to the physical condition of the sample ring beyond reasonable, normal wear and tear occurring between handover and return verification. This includes, but is not limited to:
  • Bending, warping, or structural deformation of the ring band or settings.
  • Deep scratches, gouges, cracks, or dents in the metal body or plating.
  • Missing, chipped, cracked, loose, or swapped Cubic Zirconia stones.
  • Chemical erosion, severe tarnish, peeling, or discoloration of the plating caused by exposure to liquids, cosmetics, cleaning agents, or improper handling.
  • Any unauthorized attempts to resize, modify, polish, or repair the sample ring.

8. The design consultation

• Every on-time return unlocks a complimentary couples design consultation at a participating showroom, bookable within 30 days of return.
• The consultation is free and carries no obligation to purchase anything, ever.

9. Your information

We collect your personal information (name, contact details, ID verification, card verification details, booking details) to operate the service, in accordance with our Privacy Policy at https://www.diamondsfactory.com.au/privacy-policy and the Australian Privacy Principles. By registering you consent to us contacting you about your booking and loan. We will only send you marketing communications where you have opted in, and you can unsubscribe at any time.

10. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Charges under sections 6 and 7 are limited to genuine pre-estimates of our loss and are not penalties.

11. General

• We may amend these terms prospectively at any time; the terms in force at the time of your booking apply to your loan.
• We may pause or end the service (or a showroom’s participation) at any time; existing collected loans are unaffected.
• The service is not available for commercial hire, resale, filming or events without our written agreement.
• These terms are governed by the laws of NSW, Australia.
